Terms of Service for Innerio

Welcome to Innerio! These Terms of Service ("Terms", "Agreement") govern your access to and use of the Innerio mobile application, website, and related services (collectively, the "Service"), provided and operated by Szymon Wojdat, operating as a sole proprietorship under Polish law ("Company", "We", "Us", or "Our").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. BY DOWNLOADING, ACCESSING, OR USING INNERIO, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. ELIGIBILITY & ACCOUNT REGISTRATION
A. Age Requirement
You must be at least 16 years old (or 13 years old where permitted by local law with parental consent) to access and use the Service. By using Innerio, you represent and warrant that you meet these age requirements.

B. Account Security
To access certain features, you may be required to register an account. You are solely responsible for:

Providing accurate, current, and complete information.

Maintaining the confidentiality of your account credentials.

All activities that occur under your account. You must notify us immediately at gabrielastaszak1@gmail.com if you suspect any unauthorized access.

2. ARTIFICIAL INTELLIGENCE & THIRD-PARTY SERVICES DISCLAIMER
The Service incorporates third-party Generative Artificial Intelligence (AI) technologies, including models provided by OpenAI, L.L.C. (e.g., ChatGPT API) and ElevenLabs Inc. (voice synthesis).

A. AI Output Disclaimer ("As-Is" Generation)
No Guarantee of Accuracy: Output generated by AI features ("Output") is generated probabilistically. We do not guarantee that any Output is accurate, complete, factual, or error-free.

Not Professional Advice: Output provided by the Service is for informational, creative, and entertainment purposes only. The Service DOES NOT provide medical, psychological, legal, financial, or other professional advice. Never rely on the Service for professional guidance or health/emergency decisions.

B. Assumption of Risk
You acknowledge and agree that your rely on any AI-generated Output entirely at your own risk. We disclaim all liability for any errors, hallucinations, damages, or losses resulting from your use of or reliance on AI Output.

3. USER CONTENT & ACCEPTABLE USE
A. Your Inputs and Content
You retain ownership of any text prompts, audio recordings, or other content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of operating, providing, and delivering the Service to you.

B. Prohibited Activities
You agree NOT to use the Service to:

Generate, upload, or share content that is illegal, defamatory, harmful, abusive, harassing, hate speech, violent, or sexually explicit.

Infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party.

Impersonate any person or entity, or falsely claim affiliation with any individual or company.

Attempt to reverse-engineer, decompile, extract source code, or bypass security barriers of the application or underlying AI models.

Use automated bots, scrapers, or tools to extract data from the Service without written permission.

4. INTELLECTUAL PROPERTY RIGHTS
The Service, including its design, code, interface, branding, trademarks, logos, and underlying software (excluding User Content and third-party AI frameworks), is the exclusive property of Szymon Wojdat and is protected by international copyright, trademark, and intellectual property laws.

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the application on your personal mobile devices.

5. SUBSCRIPTIONS, PURCHASES & REFUNDS
A. In-App Purchases
Certain features of the Service may require paid subscriptions or consumable in-app purchases ("Paid Features"). Pricing and terms of payment are displayed within the app prior to purchase.

B. Billing & Auto-Renewal
Payments are processed directly by third-party app distribution platforms (Apple App Store or Google Play Store). Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period in your App Store / Google Play account settings.

C. Refunds
All payments and refunds are handled exclusively through the respective app store platform (Apple or Google) in accordance with their consumer policies. We do not process direct financial refunds.

6. TERMINATION & SUSPENSION
We reserve the right, at our sole discretion, to suspend or terminate your account and access to the Service at any time, without prior notice or liability, if you violate these Terms or engage in fraudulent or illegal behavior.

Upon termination, your right to use the Service immediately ceases, and we may permanently delete your account data.

7. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SZYMON WOJDAT, HIS AFFILIATES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR AI OUTPUT.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

9. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Poland (EU), without regard to its conflict of law provisions.

Any legal dispute or claim arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Warsaw, Poland, unless mandatory consumer protection laws in your country of residence dictate otherwise.

10. CHANGES TO THESE TERMS
We may modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of these Terms and publishing the revised version on the Service. Your continued use of Innerio following any changes constitutes your acceptance of the updated Terms.
